These General Terms and Conditions (the "GTC") apply to all business relationships between LÜT GmbH ("lüt studio"), Aemtlerstrasse 28, 8003 Zürich, Switzerland, and its customers. They form part of all contracts concluded via our website (www.luetstudio.ch), by telephone, by e-mail, or by any other suitable method. Any deviating conditions of the customer apply only if expressly acknowledged in writing by lüt studio. By using our website and booking our services or purchasing our products, you agree to these GTC.
1 · Scope
These GTC govern all bookings, purchases, memberships, workshops, events and open studio use offered by lüt studio, whether arranged online, by e-mail, by telephone or on site.
2 · Conclusion of Contract
The products, services and prices published on www.luetstudio.ch are binding offers, subject to their accuracy. The contract is concluded as soon as the customer places an order via the online shop or by other suitable means. The automatically generated order confirmation merely acknowledges receipt of the order and does not guarantee actual availability. In the event of incorrect pricing, a contractual rescission relationship arises, within which any services already rendered are refunded. Further claims by the customer, in particular for damages, are excluded.
3 · Cancellation and Termination
All bookings made by the customer are binding and irrevocable. The applicable cancellation conditions vary depending on the offer and service and are set out in these GTC. We reserve the right to unilaterally withdraw from the contract in the event of the customer's negative creditworthiness. The customer is obliged to accept the ordered products; in the case of non-acceptance, lüt studio may terminate the contract and charge handling fees. In the event of a no-show, neither a new appointment may be arranged nor a refund of the course fee granted. Exceptions in cases of illness or personal circumstances are only possible in consultation and subject to capacity; in all cases, these GTC apply.
4 · Exchanges and Returns
Exchange or return of products and special custom orders at the customer's request is excluded.
5 · Products
Lüt studio sells handcrafted ceramics. Minor external deviations between products of the same type, or from the product images published on www.luetstudio.ch, cannot be excluded.
6 · Prices and Availability Information
The prices and availability information on www.luetstudio.ch are provided without guarantee. We assume no liability for the accuracy, completeness or timeliness of the information. Unavailability of delivery or incorrect price information constitutes grounds for rescission. All prices are final prices.
7 · Payment Terms
For bookings made via our website, the amount is due immediately by credit card. For group events, workshops and special custom orders, the customer is obliged to settle the invoice within 20 days of the invoice date, unless already paid by credit card, Twint or prepayment. From the second reminder onward, a handling fee of CHF 20 may be charged. Offsetting against any claims toward lüt studio is only permitted if expressly acknowledged in writing by lüt studio. The goods remain the property of lüt studio until full payment of the purchase price.
8 · Delivery
Delivery is made to the address specified by the customer. Shipping costs are calculated on a case-by-case basis and displayed before ordering.
9 · Warranty
The customer must inspect the goods immediately upon receipt and report any defects within three days. Warranty claims expire for consumers after two years in accordance with Art. 210 of the Swiss Code of Obligations, and for business customers after twelve months. The warranty for handcrafted ceramics is limited to replacement or refund of the purchase price.
10 · Returns
In the event of returns of defective products, the customer bears the costs. A copy of the purchase invoice must be included.
11 · Course Schedule and Changes
We reserve the right to cancel or postpone workshops and open studio sessions due to unforeseen circumstances such as illness, an insufficient number of participants, or force majeure. In the event of a cancellation by the studio, the participant will be rebooked, the fee fully refunded, or, at the participant's request, converted into a voucher. Rebookings may only be made for the same course, on a different date, and subject to sufficient capacity. If the customer wishes to attend a different course, the difference relative to the originally booked course will be charged or paid out in the form of a voucher.
12 · Workshops
General information
All workshops and events are listed on www.luetstudio.ch and must be booked either via our booking system or on site at the studio. Payment is due immediately. The customer has no claim to unpaid offers.
Cancellation conditions
Cancellations must be made in writing by e-mail to hallo@luetstudio.ch.
- Up to 21 days before the start: free cancellation.
- Up to 10 days before the start: free rebooking, or a 100% refund in the form of a voucher.
- Up to 24 hours before the start: no refund, but a name change can be made by e-mail to hallo@luetstudio.ch.
Multi-part courses
It is the responsibility of the participant to attend all course sessions. If a session is missed, it may be rescheduled after consultation and subject to availability. However, there is no right to make up more than one session.
Success of the ceramics
There is no claim to a finished object if participants, through their own fault, have not produced anything or a finished object on site.
Working in specified techniques
In all cases, the work must be carried out using the specified techniques. Participants may not freely decide which techniques or forms to use if these require a specific technique or deviate significantly.
Price & services
The price per person is independent of the actual use of all offered services. This means that even if certain elements of the offer are waived, the full amount per person is payable.
Finished works
Works must be collected within 30 days after notification. Uncollected works are deemed unwanted after this period and disposed of. An invoice for handling and disposal fees will be sent to the booker.
Booking for third parties
The person making the booking is responsible for the collection and payment of all materials, including those for other participants. If collection or payment does not occur, this person bears the resulting costs.
13 · Events
General information
Bookings are made exclusively on request and become binding upon acceptance of the offer and confirmation by lüt studio. The contract for booking an event supplements these GTC. Should any individual provisions of the event contract deviate from these GTC, the provisions of the event contract prevail.
Cancellation conditions
Cancellations must be made in writing by e-mail to hallo@luetstudio.ch. Please note that once a booking is confirmed, a flat administration fee of CHF 100 will be charged for any cancellation. In addition, cancellation fees apply based on the timing of your cancellation:
- 30 days before the event: 20% of the total price will be charged.
- Between 30 and 14 days before the event: 50% of the total price will be charged.
- Less than 14 days before the event: the full amount will be charged.
14 · Open Studio
Access requirements
To gain access to the workspace, users must possess the necessary skills in the relevant discipline. Users must be capable of operating the wheel / modelling, glazing, and handling the materials independently.
Booking and cancellation
No refunds are provided if an open studio booking is cancelled. Rescheduling is free of charge up to 12 hours before the start of the booked time slot. Rescheduling requests can be made by e-mail to hallo@luetstudio.ch. In the event of a no-show, neither refunds nor rescheduling are possible.
Space usage and booking
Booking an open studio slot through our website is mandatory and can be made up to 12 hours before the start of the session. Participants are requested to remain in the main room; the members' room is excluded from use.
Access and availability
During scheduled events or courses, the workspace remains closed and inaccessible. We reserve the right to cancel open studio slots if necessary, with a minimum notice period of 5 days.
End of session
The session must end on time. All users are required to clean their workspace and the materials used at the end of the session according to the provided instructions and, where possible, store them appropriately.
Studio introduction
In order to use the workspace, all new users are required to attend a studio introduction after their first booking. This introduction lasts 15 minutes, is free of charge, and is included as part of the slot.
Open studio pricing
When booking a time slot, the participant pays exclusively for the use of the infrastructure. Each work process (throwing / modelling, trimming, glazing) requires a separate slot booking due to drying times and any necessary firing processes. All additional services are charged as follows:
- Clay for practice (unfired, natural beige clay): free of charge.
- Any other clay used for practice (unfired): CHF 4 / kg.
- Bisque firing including clay: CHF 15 / kg.
- Bisque firing including clay, materials for glazing and glaze firing: CHF 30 / kg.
All other scenarios fall under the firing and glazing service and must be requested by e-mail at hallo@luetstudio.ch.
Firing process
All firing processes are carried out exclusively by our staff. Works are fired every 1 to 3 weeks depending on the kiln's availability. Notification is given when the works have been fired.
Bisque firing: all items placed on the "Bisque Fire" shelf are considered ready for bisque firing. Materials placed on this shelf can no longer be recycled. The user is responsible for payment of all fired materials. Glaze firing: all items placed on the "Glaze Fire" shelf are considered ready for glaze firing. The user is responsible for the proper preparation of the objects (e.g. cleaning the base) and for payment of all fired materials.
Signature
All items must be clearly and legibly signed on the underside. This signature identifies the objects as the user's property.
Damaged or finished works and works in progress
No refund is given for damaged or unsatisfactory works. All fired materials must be paid for, even if they are damaged. If damage is caused by our staff during handling, the works are not charged. Finished works are retained for a maximum of 30 days. After this period, uncollected works are disposed of, and an invoice for handling and disposal fees is issued to the user.
Works in progress: all pieces that are still in progress (i.e. before the first bisque firing) may be stored at the studio for a maximum of 30 days. After this period, if no further work or communication occurs, the pieces are recycled without prior notice. A fee of CHF 8 per kilo of clay is charged to cover the associated effort, in particular the regular checking and keeping of the pieces moist to ensure they remain workable, as well as the recycling of the clay. This fee is invoiced via SumUp payment request by e-mail. It is the responsibility of users to keep track of how long their pieces have been stored.
Improper handling of materials
The use of unsuitable materials for glazing or decorating non-bisque-fired items is strictly prohibited. In case of violation, the user bears the costs for any damage to the kiln.
External materials
The use of external materials is not permitted. All materials processed in the studio must come from the studio.
Work guidelines
Compliance with studio rules according to the guidelines is mandatory. In case of improper use of materials or premises, the user is liable for any damage incurred. In such cases, lüt studio reserves the right to refuse future bookings. Inappropriate behaviour towards other users or staff allows lüt studio to revoke and deny future access to the studio. In such cases, no refund is provided for bookings or materials. Additionally, bringing other persons into the studio is not permitted (including children).
15 · Memberships
Minimum requirement
To become a member, you must complete a pottery course in the desired discipline. Members must understand the processes of forming, glazing and firing.
Membership material pricing
Additional services are available at the following rates:
- Bisque firing including clay: CHF 12.50 / kg.
- Bisque firing including clay, glazing materials and glaze firing: CHF 25 / kg.
Pausing
Pausing a membership is generally not possible unless the member provides a replacement with sufficient ceramic experience to cover the vacancy in monthly increments. Exceptions may be granted for health reasons. All requests must be approved via e-mail.
Termination of membership
Memberships renew automatically for the same duration (3, 6 or 12 months) and must be terminated at least 30 days before renewal, in writing by e-mail to hallo@luetstudio.ch. Until termination, the customer is billed via the indicated payment method.
Additional agreement for memberships
Upon concluding a membership, a separate contract is signed in addition to these GTC. This contract regulates specific rights and obligations within the membership and complements these GTC. In case of contradictions, the provisions of the membership contract take precedence.
16 · Gift Vouchers
Refunds
Vouchers are non-refundable and cannot be redeemed for cash.
Use
Vouchers intended for a specific workshop are valid only for that workshop. Transfer to other offers is possible if the difference is paid. Materials not included in the voucher must be paid separately. Refunds of remaining amounts are not possible. Value vouchers can be used for all fee-based services and products available on www.luetstudio.ch or on site. No cash is given for remaining balances.
17 · Liability
Participation at own risk
Participation in courses and open studio sessions is at the participant's own risk. lüt studio assumes no liability for accidents or injuries that occur during participation.
Liability for material damage
lüt studio is not liable for damage to or loss of items made or stored during courses or open studio sessions. This includes, in particular, damage occurring during the firing and glazing process, such as breaks, cracks, distortions or colour deviations.
Responsibility for proper use
Participants are responsible for the proper handling of tools, materials and equipment, and must adhere to the studio's safety regulations at all times.
No warranty for end products
The studio does not guarantee the quality or durability of products made during courses or open studio sessions. No refunds or repeat sessions are provided for unsatisfactory results or damaged items.
Liability for additional working hours
The studio is not obliged to offer additional hours for the completion of unfinished objects.
Liability for improper use
The studio assumes no liability for damage caused by improper use of tools, machines or materials. Participants are fully liable for damage caused by disregard of instructions or studio rules.
18 · Changes to Services and Prices
Prices for products and services can be changed without prior notice. Changes to the offered services can be made at any time without assuming liability.
19 · Changes to the General Terms and Conditions
lüt studio may update these GTC at any time. Continued use of the website or services constitutes acceptance of the changes. Please check this page regularly.
20 · Copyright
The copyright for the website www.luetstudio.ch and its content is fully owned by lüt studio. Copying, downloading or otherwise using parts of the website without explicit written permission is not permitted.
21 · Severability Clause
Should any provision of these GTC or an annex be invalid, the validity of the remaining provisions remains unaffected. The parties will replace the invalid provision with a valid provision that closely approximates the economic purpose. This also applies to any contractual gaps.
22 · Force Majeure
In the event of force majeure, such as natural disasters or other extraordinary circumstances preventing contract fulfilment, lüt studio is exempt from the performance obligation.
23 · Jurisdiction and Applicable Law
The jurisdiction for all disputes arising from or in connection with these GTC is Zürich, Switzerland. Swiss law applies.
Privacy Policy
We treat your personal data confidentially and in accordance with applicable data protection regulations and this privacy policy. By using our website, you agree to the collection and use of your data by us in accordance with this privacy policy. Any changes to our privacy policy are published on this page.
Our customer database is treated with strict confidentiality. All information collected on this website will not be shared, sold, rented or disclosed to third parties.
In cooperation with our hosting provider, we make every effort to protect the databases from unauthorised access, data loss, misuse or falsification. Please note that data transmission over the internet can have security vulnerabilities; complete protection of the data from access by third parties is not possible.
